This area of law covers common law restraints of trade and European and
national competition law. Competition law affects everything that we do in
NIPC including joint ventures, intellectual property licences, distribution
and franchise agreements. There is a close interface between restrictive
covenants and the law of confidence in employment and joint ventures.
Jane Lambert
learned her competition law when she was legal advisor to Visa International
for Europe, the Middle East and Africa when she assisted in her employer's
application for an exemption and negative clearance under what is now art 81
(3) of the Treaty of Rome. She developed this interest in private
practice using her knowledge to good effect in franchising disputes. She was
also instructed frequently in employment and other restrictive
covenant cases.
Jane reviews all sorts of commercial agreements for compliance with EC and
UK competition law. She drafts enforceable restrictive covenants,
confidentiality agreements and terms and conditions. She appears in
injunction applications including applications for search orders. She
accepts instructions for the Competition Appeal Tribunal and the Chancery
Division.
